These General Conditions regulate the acquisition of the services offered on the website https://www.mialmazarahotel.com, owned by Gestión Hotelera Comprometida, S.L (hereinafter, GHC).

The acquisition of any of the services implies the full and unreserved acceptance of each and every one of the General Conditions indicated herein, without prejudice to the acceptance of the Specific Conditions that may apply when acquiring certain services.

These General Conditions may be modified without prior notice, therefore it is advisable to read their content carefully before proceeding to the acquisition of any of the services offered.

All notifications and communications between users and GHC will be considered effective for all purposes when made through any of the aforementioned means.

3. SERVICES

The services offered, along with their main characteristics and price, appear on screen.

GHC reserves the right to decide, at any time, the products and/or services offered to Clients. Thus, GHC may at any time add new products and/or services to those currently offered. Likewise, GHC reserves the right to withdraw or stop offering, at any time and without prior notice, any of the services offered. GHC also reserves the right to withdraw or cease offering, at any time and without prior notice, any of the services offered.

All this without prejudice to the fact that the acquisition of any of the services may only be carried out through the USER’s subscription or registration, whereby GHC will provide the interested party with a Username and password, which will identify and enable them personally to access the services.

Once inside https://www.mialmazarahotel.com, and to access the contracting of the various services, the User must follow all the instructions indicated in the purchase process, which will imply reading and accepting all the general and specific conditions set forth on https://www.mialmazarahotel.com.

4. AVAILABILITY AND SUBSTITUTIONS

GHC aims to guarantee the availability of all the products advertised through www.mialmazarahotel.com. However, if any requested product is not available, the client will be informed by email as soon as the product becomes available.

If the product is not available, and the consumer has been informed of this, GHC may supply a product with similar characteristics without a price increase, in which case the consumer may accept it or reject it by exercising their right of withdrawal and termination of the contract.

In case of unavailability of all or part of the order, and the customer’s rejection of substitute products, the previously paid refund will be made in the same manner as the payment.
If GHC unjustifiably delays the refund of the paid amounts, the consumer may claim double the owed amount.
For the provision of services, GHC will grant access as follows: via username and password.

GHC is not responsible for any damages or losses that may occur to the USER due to failures or disconnections in telecommunications networks that result in the suspension, cancellation, or interruption of the service at https://www.mialmazarahotel.com during its provision.

5. PURCHASE AND/OR CONTRACTING PROCESS

INVOICING

Along with your order, you will receive the corresponding invoice.
To this end, the customer agrees to receive the invoice in electronic format.

6. PRICES, EXPENSES AND TAXES

The prices of the services listed on https://www.mialmazarahotel.com are expressed in Euros (unless otherwise stated) and are guaranteed during their period of validity, except for printing errors, regardless of the order’s destination.

The final prices of all services, along with their features, offers, discounts, etc., are reflected in each of the services offered.

  • The VAT rate is 21%.


Service prices may change at any time. In this case, the applicable price will be the one in effect at the time the order is placed. In any event, the final cost will be communicated to the client during the electronic purchasing process before they confirm the purchase.

7. PAYMENT METHODS

We offer the following payment methods:

You can pay immediately through the secure SSL payment gateway of our bank. If a return or cancellation is required, the amount will be refunded to the same card. If any refund or order cancellation is necessary, the amount will be refunded via the same payment card.

c. PayPal
Payment will be authorized through PayPal, but funds will not be withdrawn until PayPal confirms the transaction. A PayPal account is required.

8. RETURN AND WITHDRAWAL POLICY

According to current legislation, the consumer has the right to withdraw from the contract within a maximum period of 14 calendar days without providing any reason and without incurring any cost, except as specified in Articles 107.2 and 108 of Royal Decree 1/2007 of November 16.

This right does not apply to:

  • Services that have already been executed or begun.
  • Products made to the consumer’s specifications or clearly personalized, or that cannot be returned due to their nature or could deteriorate quickly.

  • Audio/video recordings or software that have been unsealed by the user.
  • Accommodation or leisure services with a specific date or period of execution.

he withdrawal period is 14 calendar days from the date of the contract. The user must notify GHC of their intention to exercise this right using the withdrawal form provided at the end of this document.

Exercising this right will result in the suspension of the service.
GHC will confirm receipt of the withdrawal on a durable medium.

Withdrawal implies that GHC will refund the amount paid by the customer within a maximum of 14 calendar days, using the same payment method used by the customer (as long as the service does not fall within the exceptions listed above).

Upon receiving your request, we will contact you to coordinate the refund.

9. CUSTOMER SERVICE AND COMPLAINTS

To submit any complaint or claim, the customer should contact our customer service department.

In accordance with EU Regulation 524/2013 on Online Dispute Resolution, we inform you that the European Commission provides a platform for dispute resolution available at: http://ec.europa.eu/consumers/odr/

10. APPLICABLE LAW

These terms and conditions are governed by the laws of Spain.

The language used shall be Spanish.
